Cyber amendment/annex to FSA/FSP due within the next calendar year

Jessica Whipple

As required by 33 CFR parts 105 and 106, facility owners and operators are now required to conduct a cybersecurity assessment and submit to the local Captain of the Port (COTP) an amendment or annex to their Facility Security Plan (FSP) as part of the facility's annual audit.

Effective October 1, 2021: Facility owners/operators have until October 1, 2022 to submit the amendment/annex to their plan - the deadline for each facility is the submission date for their annual audit.

Per recent distribution from USCG: "COTPs will verify that facilities have addressed cybersecurity within the FSA and FSP cyber amendments/annexes. COTPs retain discretion on whether the requirements have been met, and on any potential extension of submission dates."
